Checked 7 Nov 2026 · Not legal advice
Deadline to file
3 years
In New York, most injury lawsuits must be filed in court within three years1.
If you were partly at fault
Pure comparative
In New York, your share of the fault usually lowers what you can recover without stopping you from recovering. In some motor-vehicle (no-fault) cases started after the May 2026 change, you can’t recover if you were more at fault than the other side2.
Other deadlines
Some claims have different or shorter deadlines, such as claims against a city or the state, claims for a death, or claims for a child. Ask each firm which deadline applies to you.

Car insurance in New York
After a crash, these rules decide whose insurance may pay and what you can claim. Ask your insurance company what your own policy has.
No-fault benefits
Up to $50,000 per person
New York uses no-fault car insurance. A car’s policy pays “first-party benefits” to people hurt through the use of that car, whoever caused the crash1. It pays up to $50,000 per person in total, for needed medical costs, lost pay up to $2,000 a month for up to three years, and other needed costs2.
Suing for pain and suffering
Only for a “serious injury”
You can’t sue the other driver for pain and suffering unless the injury is a “serious injury”3. That includes death, a broken bone, losing a body part, major scarring, losing a pregnancy, and some lasting or major limits on how your body works2.
