Medical malpractice cases in New York: what to know
Checked 7 Nov 2026 · Not legal advice
Deadline to file
2 years 6 months
In New York, a medical, dental or podiatric malpractice action “must be commenced within two years and six months of the act, omission or failure complained of or last treatment where there is continuous treatment”1.
That is the deadline for medical malpractice cases. The usual deadline for other injury claims in New York is 3 years.
If you were partly at fault
Pure comparative
In New York, your share of the fault usually lowers what you can recover without stopping you from recovering. In some motor-vehicle (no-fault) cases started after the May 2026 change, you can’t recover if you were more at fault than the other side2.
Other deadlines
Some claims have different or shorter deadlines, such as claims against a city or the state, claims for a death, or claims for a child. Ask each firm which deadline applies to you.
